Strah od covid-diktature u Europi
Napad je najbolja obrana. Viktor Orban je preventivno napao Europsku uniju zbog mogućih kritika na račun zakona koji mu osigurava izvanredne ovlasti. U jednom radijskom intervjuu, on je u ponedjeljak (30.3.) ujutro rekao: „Jasno sam poručio gunđalima iz Europske unije da sad nije vrijeme za pametovanja i pravna prepucavanja.” Nakon krize će biti dovoljno vremena za diskusije, dodao je. „Ako već ne mogu pomoći, a ne mogu, onda barem ne bi trebali smetati Mađarima u obrani.”
Europska komisija je na tu polemiku odgovorila argumentima: pomaže se koliko je to moguće, izjavio je glasnogovornik Eric Mamer, i dodao kako Mađarska ima pravo na pet milijardi eura pomoći iz novog posebnog fonda za borbu protiv korone – npr. kako bi poboljšala stanje u zdravstvu. Osim toga vlada u Budimpešti svake godine iz proračuna EU-a dobije milijarde eura, Mađarska je najveći neto primatelj sredstava Unije.
Kritike sa svih strana
Na kritiku se nije trebalo dugo čekati, i ona nije stigla samo iz Bruxellesa. Glavna tajnica Vijeća Europe Marija Pejčinović Burić opomenula je da zemlje članice moraju očuvati temeljna demokratska načela. Vremenski neodređeno i nekontrolirano izvanredno stanje to ne može osigurati, dodala je. Debata u medijima je bitan element slobodarskog i demokratskog poretka, rekla je Pejčinović Burić.
Novim zakonom se predviđaju zatvorske kazne za navodno „lažne” informacije o koroni, pa i za one informacije koje objavljuju novinari. Postoji bojazan da bi se time moglo sankcionirati ili čak spriječiti svaku vrstu izvještavanja koje se vladi ne sviđa.
I OESS-ova organizacija za zaštitu građanskih prava protestirala je protiv mađarskog zakonodavstva, jer smatra da nije u skladu s međunarodnim standardima. Brojne organizacije za zaštitu ljudskih i građanskih prava u Europi kritizirale su mađarski zakon o izvanrednim ovlastima premijera Viktora Orbana koji je parlament u Budimpešti usvojio u ponedjeljak popodne.
Nadležni odbor u Europskom parlamentu je podsjetio da mjere u borbi protiv koronavirusa ne smiju kršiti temeljna prava, načela pravne države i demokratske principe. Od Europske komisije se zahtijeva da provjeri ispunjava li Mađarska još uvijek svoje obveze koje je preuzela Europskim ugovorima.
S takozvanim Postupkom iz članka 7. EU može pokrenuti provjeru u slučaju da sumnja u kršenje vladavine prava i vrijednosti EU-a. Moguća sankcija je privremena suspenzija prava glasa. Ili „rezanje” sredstava iz fondova EU-a. Taj postupak se u praksi nije pokazao najučinkovitijim, zato što se odluka mora donijeti jednoglasno. Protiv Mađarske taj postupak traje od 2018. On prijeti i Poljskoj. Te dvije zemlje se u Europskom vijeću mogu dakle međusobno „štititi”. Postupak protiv Mađarske je praktički zamrznut. Nova Komisija pod vodstvom Ursule von der Leyen najavljivala je da se želi pozabaviti tom temom, ali do sada se ništa nije dogodilo. U načelu EU u ovom trenutku nema u rukama nikakve konkretna sredstva kojima bi mogla djelovati protiv Orbanovih ovlasti.
Kopiranje mađarskog recepta?
Dopredsjednica Europskog vijeća, zastupnica njemačkog SPD-a Katharina Barley, boji se osim toga da bi i neki drugi državnici mogli pokušati progurati izvanredne neograničene ovlasti: „Mađarska je svojevrsna avangarda za druge nacionaliste i populiste EU-a. I neki drugi koji bi htjeli biti autokrati, u Poljskoj, Litvi i drugdje, oni su uvjereni da bi mogli slijediti mađarski primjer.” Ako Orban uspije u svojoj namjeri, to bi ih moglo ohrabriti, smatra Barley.
“Europska unija je predugo čekala”, kritizira njemačka političarka. Europske institucije bi, smatra ona, morale Mađarsku „izvesti” pred Europski sud. „Ali sumnjam da će Europsko vijeće išta poduzeti u vremenima korona-krize.”
Sličnog je mišljenja i njemački zastupnik u Europskom parlamentu Sergey Lagodinsky iz Stranke zelenih: “Nikako ne smijemo tolerirati covid-diktaturu. Nikakva izvanredna situacija ne opravdava ukidanje parlamenta na neograničeno vrijeme.”
Strah mađarske oporbe
I mađarska EU-zastupnica Klara Dobrev (Demokratska koalicija) se boji da Orban želi iskoristiti sadašnju krizu kako bi zacementirao moć: „Ovdje se ne radi o odgovoru na korona-krizu, već o Orbanovom konceptu neliberalne demokracije. On želi demontirati ono što je ostalo od oporbe, i to tako što tvrdi da socijalisti blokiraju borbu protiv korone.” Orbanu je potreban novi neprijetelj, jer više nema migranata, dodaje Dobrev.
Oporba u Mađarskoj, kaže naša sugovornica, sad od EU-a očekuje da jasno formulira svoje stavove i sumnje i da pokrene mehanizam koji bi promatrao poštuje li Mađarska još uvijek načela pravne države.
Neopravdane kritike na račun Orbana?
Daniel Caspary, zastupnik EPP-a (Europska pučka stranka) u Europskom parlamentu, na cijelu stvar gleda znatno opuštenije. Članstvo Orbanove stranke Fidesz u klubu europskih kršćanskih demokrata je doduše suspendirano, ali veze nisu u potpunosti prekinute, priča on. Casparz u izvanrednim ovlastima ne vidi toliko pokušaj preuzimanja moći, već ga smatra više Orbanovim pokušajem da vlastitom stanovništvu demonstrira kako je sposoban djelovati.
“Uznemirujućim” ipak smatra činjenicu da izvanredno stanje nije vremenski ograničeno, mađarski parlament ga doduše može u svakom trenutku opet ukinuti. A da bi to uspio protiv volje svog stranačkog šefa i mađarskog premijera, ukidanje ovlasti bi morao podržati i znatan dio Fideszovih zastupnika. Ta stranka u parlamentu ima dvotrećinsku većinu. Caspary na koncu dodaje i kako je prijetnja kaznama za takozvano „nedozvoljeno izvještavanje” o koronavirusu – pogrešan odgovor na opravdan problem.
