Grad Gradačac nije uspio vratiti u posjed vlastitu imovinu!?

Gradska uprava danas se oglasila saopštenjem povodom dešavanja oko “Tržnice Arizona”. U saopštenju se kaže:

“U proteklih nekoliko dana pojavile su se određene špekulacije oko trenutne situacije na pijaci na Porebricama. U nastavku ovog teksta donosimo vam činjenično stanje vezano za istu.

Zakupcu “Nova pijaca”, d.o.o. Porebrice je Ugovor o zakupodavnom odnosu  istekao 15.03.2021.godine.

Zakupac je na predmetnom zemljištu imao zaključene ugovore sa podzakupcima, radi obavljanja trgovačke djelatnosti, a shodno odredbama člana 590. Zakona o obligacionim odnosima a koji prestaje u svakom slučaju kada prestane zakup.

Zaključkom Gradskog vijeća od 06.02.2020.godine je određeno da se buduće davanje u zakup neizgrađenog građevinskog zemljišta na parceli k.č.br. 1395/23 k.o. SP Porebrice, a za koje je “Nova pijaca” doo Porebrice, imala zaključen ugovor o zakupu do 15.03.2021. god. vrši isključivo javnim pozivom, putem licitacije, te da se obavezuje Gradska služba za geodetske i imovinsko-pravne poslove da pokrene postupak licitacije za davanje u zakup navedenog zemljišta.

24.02.2021. u Dnevnom listu „Oslobođenje“ objavljena je odluka o poništenju ranijeg oglasa, te javni oglas o izdavanju u zakup zemljišta radi organizovanja tržnice/pijace u k.o. Porebrice, putem licitacije, na web stranici, oglasnoj ploči Grada Gradačac i Radio stanici Gradačac.

Licitacija je održana 12.03.2021.god. u prostorijama Grada Gradačac na koju   se prijavilo 5 (pet) učesnika.

Nakon provedenog postupka licitacije, kao najpovoljnija utvrđena je ponuda ponuđača „Tiha luka“ doo Sarajevo u iznosu od 1.050.437,20 KM, kao mjesečna zakupnina, te je komisija predložila Gradu Gradačac da se sa najpovoljnijim ponuđačem zaključi ugovor o zakupu, a po preuzimanju objekta zakupa od dosadašnjeg zakupca “Nova pijaca“ doo Porebrice, nakon isticanja ugovora o zakupu.

Dana 16.03.2021.god. komisija Grada Gradačac je izašla na lice mjesta kako bi preuzela predmet zakupa, ali isti nije predat u posjed. Od strane direktora “Nova pijaca“ doo Porebrice, Porović Saudina je izjavljeno da su u toku postupci po tužbi „Nove pijace“ Porebrice prema Gradu Gradačac i ostalima, a svaku dalju aktivnost će smatrati pokušajem nasilnog oduzimanja posjeda.

S obzirom da Grad Gradačac nije preuzeo zemljište na kome se nalazi pijaca i isto dosadašnji zakupac koristi bez ikakvog pravnog osnova služba je spise predmeta dostavila Gradskom pravobranilaštvu  i nadležnim inspekcijama radi preduzimanja daljih radnji” – stoji u saopštenju Grada Gradačca.

Iz ovog saopštenja je vidljivo da je dosadašnji zakupac Nova pijaca d.o.o. već ranije tužila Grad Gradačac. Zašto Gradska uprava nije tužila Novu pijacu d.o.o. koja joj duguje enormno veliki iznos i sada bez ugovora gazduje gradskom imovinom je pravo pitanje na koje još uvijek nema odgovora.
