Grad Gradačac prodaje četiri parcele u vlasništvu grada putem javnog nadmetanja-licitacijom
Na osnovu člana 363. Zakona o stvarnim pravima («Sl.novine F BiH», broj 66/13 i 100/13 ),
člana 7. i 8. Pravilnika o postupku javnog konkursa za raspolaganje nekretninama u vlasništvu Federacije Bosne i Hercegovine, kantona, općina i gradova («Službene novine F BiH» br.17/14), člana 3. Odluke o prodaji nekretnina broj:01-04-373/21 od 02.11.2021.(Službeni glasnik Grada Gradačac br.11/21) Gradonačelnik Grada Gradačac, objavljuje
J A V N I O G L A S
za prodaju nekretnina u vlasništvu Grada Gradačac
putem javnog nadmetanja-licitacijom
I PREDMET JAVNOG OGLASA
Grad Gradačac sa sjedištem u Ulici H.K.Gradaščevića, putem javnog nadmetanja-licitacijom prodaje nekretnine označene kao:
1.k.č.br.1538/33 Zurkuša oranica njiva 6.klase 584 m2 upisana u el.zk.ul.br. 4277 k.o. GradačacII, upisana kao vlasništvo i posjed Grad Gradačac sa 1/1, sa početnom prodajnom cijenom od 17.520,00 KM (sedamnaesthiljadapetstotinadvadesetKM), odnosno 30 KM/m2.
Nakon izvršenog uvida u namjenu površina ustanovljenu na grafičkom prilogu br.A 16 (R1:7000)-naseljeno mjesto Gradačac, sstavni dio Prostornog plana Grada Gradačac za period 2008-2028, utvrđeno je da je na predmetnoj nekretnini predviđeno građevinsko zemljište pretežne namjene stanovanja-planirano, s tim da šume i šumsko zemljište zahvata samo mali krajnji južni dio te parcele. Prema karti ugroženih područja (sastavnog grafičkog priloga Prostornog plana Grada Gradačac), na toj parceli je ustanovljen nestabilan teren i to tip 1 aktivna i reaktivirana klizišta.
2.k.č.br.1205/29 Duga njiva ornica njiva 5.klase 361 m2 i
-k.č.br.1205/35 Duga njiva oranica njiva 5.klase 66 m2 upisane u el.zk.ul.br.4209 k.o. GradačacI, upisane kao vlasništvo i posjed Grada Gradačac sa 1/1, sa početnom prodajnom cijenom od 13.664,00 KM (trinaesthiljdašestotinašezdesetičetiriKM), odnosno 32 KM/m2.
Nakon izvršenog uvida u namjenu površina ustanovljenu na grafičkom prilogu br.A 16 (R1:7000)-naseljeno mjesto Gradačac, sstavni dio Prostornog plana Grada Gradačac za period 2008-2028, utvrđeno je da je na obje predmetne parcele predviđeno građevinsko zemljište pretežne namjene stanovanja-postojeće.
3.k.č.br 1907 Dvorište kuća i zgrada 69 m2 i dvorište 286 m2 upisana u el.zk.ul.br.845 k.o. Mionica II, upisana kao posjed i vlasništvo Grad Gradačac sa 1/1, sa početnom prodajnom cijenom od 2.840,00 KM (dvijehiljadeosamstotinačetrdesetKM), odnosno 8 KM/m2.
Na predmetnoj parceli se nalazi stari stambeni i pomoćni objekat u ruševnom stanju, a kojima je obezbijeđen kolski pristup prilaznim putem koji se spaja na lokalni put u Mionici.
Predmetna parcela je u obuhvatu Prostornog plana Grada Gradačac za period 2008-2028 na kome je ustanovljeno građevinsko zemljište pretežne namjene stanovanja –planirano.
4.k.č.br. 659/5 PLAC oranica/njiva 6.klase površine 466 m2 k.o.Gradačac I, upisana u el.zk.ul.br.4209 k.o.Gradačac I, kao vlasništvo i posjed Grada Gradačac sa 1/1, sa početnom prodajnom cijenom od 12.815,00 KM (slovima: dvanaesthiljadaosamstotinapetnaestKM.) odnosno 27,50 KM/m2.
Nakon izvršenog uvida u izvod iz Prostornog plana općine Gradačac za period 2008-2028.godina predmetna parcela je građevinsko zemljište pretežne namjene stanovanja-planirano.
II PRAVO UČEŠĆA
Pravo učešća na licitaciji imaju sva pravna i fizička lica koja nemaju neizmirenih obaveza prema Gradu Gradačac i Poreznoj upravi, po bilo kom osnovu.
Učesnici su dužni neposredno pred održavanje postupka licitacije podnijeti:
-lična karta za fizička lica,
-rješenje o upisu u sudski registar ili aktuelan izvod iz sudskog registra, ne stariji od 3 mjeseca, za pravna lica
-punomoć u formi notarski obrađene isprave za lica koja ne učestvuju u svoje ime,
-dokaz da ponuđač nema neizmirenih obaveza prema Gradu Gradačac i Poreznoj upravi po bilo kom osnovu (potvrda budžeta Grada Gradačac i Porezne uprave),
-potvrdu o uplaćenoj kapari u iznosu od:
-1.752,00 KM (hiljadusedamstotinapedesetidvijeKM), za parcelu pod rednim br.1.
-1.366,00 KM (hiljadustristotinešezdesetišestKM), za parcelu pod rednim br.2
-1.000,00 KM (jednahiljadaKM) za parcelu pod rednim brojem 3.
-1.281,00 KM (hiljadudvijestitneosamdesetijedna KM) za parcelu pod renim brojem 4.
Za učešće u postupku licitacije učesnici su dužni uplatiti kaparu koja iznosi 10% od početne cijene nekretnine
Kaparu uplatiti na račun Grada Gradačac br.1321900309659853 otvoren kod NLB banke.
Učesnicima čija ponuda ne bude prihvaćena izvršiti će se povrat položene kapare i to u roku od 3 dana od dana održavanja licitacije.
Učesniku licitacije čiji je ponuđeni iznos kupoprodajne cijene utvrđen kao najpovoljniji, iznos kapare će biti uračunat u kupoprodajnu cijenu.
Javni oglas o prodaji će biti objavljen u Dnevnom listu «Oslobođenje», oglasnoj ploči Grada, na web stranici Grada Gradačac i na radio stanici Gradačac.
Javni oglas ostaje otvoren 15 dana od dana objavljivanja u dnevnom listu «Oslobođenje».
III VRIJEME I MJESTO ODRŽAVANJA LICITACIJE
Licitacija će se održati u prostorijama Gradske službe za geodetske i imovinsko-pravne poslove, soba br.11. u Gradačcu ulica H.K.Gradaščevića, dana 27.12.2021.god. u 9:00 sati.
IV USLOVI LICITACIJE
Postupak licitacije provodi Komisija za prodaju nekretnina, imenovana od strane Gradonačelnika.
Licitacija se može održati samo ako u njoj učestvuju najmanje dva učesnika.
Ako se na licitaciju javi samo jedan učesnik, smatra se da je javno nadmetanje bezuspješno i licitacija se ponavlja.
Ako se na ponovljenu licitacijujavi samo jedan učesnik, komisija može pristupiti postupku prodaje nekretnine neposrednom pogodbom, pod uslovom da ponuđena cijena ne može biti niža od početne cijene, objavljene u oglasu o licitaciji.
Ako ne uspije ni ponovljena licitacija, smatra se da je javno nadmetanje bezuspješno, te Odluka oprodaji nekretnina prestaje da važi.
Sa učesnikom licitacije čija ponuda bude utvrđena kao najpovoljnija, zaključiti će se ugovor o kupoprodaji, u formi notarski obrađene isprave, u roku od 30 dana od izbora najpovoljnijeg ponuđača.
Kupoprodajnu cijenu kupac je dužan isplatiti odmah po potpisivanju ugovora, na investicioni račun Grada Gradačac 1321900309659853, otvoren kod NLB banke Gradačac.
Ukoliko kupac ne potpiše ugovor u navedenom roku ili ne izvrši uplatu kupoprodajne cijene, ima se smatrati da je odustao od kupovine, te će biti raspisan novi postupak licitacije.
Troškove notarske obrade ugovora kao i troškove uknjižbe snosi kupac.
