Nema vraćanja “bijelog hljeba” u Parlament BiH, Ustavni sud odbacio zahtjev
Registrar Ustavnog suda BiH Zvonko Mijan izjavio je Srni da je Ustavni sud apelaciju odbacio jer je podnesena od neovlaštenog podnosioca.
“Apelaciju je prvobitno potpisalo 11 članova Predstavničkog doma, od kojih su dva povukla svoj potpis, što znači da ih je ostalo devet, a to je manje od potrebne jedne četvrtine od 42 zastupnika u Predstavničkom domu Parlamenta BiH”, rekao je Mijan.
U oktobru prošle godine 11 bivših zastupnika u Predstavničkom domu podnijelo je apelaciju Ustavnom sudu, kojom su tražili ocjenu ustavnosti izmjena navedenog zakona.
Apelaciju su potpisali Momčilo Novaković, Salko Sokolović, Sadik Ahmetović, Zaim Backović, Predrag Kožul, Nikola Lovrinović, Borislav Bojić, Đorđo Krčmar, Nenad Lalić, Miroslav Milovanović i Jovan Vukovljak.
Sokolović i Ahmetović su, nakon što su im zaprijetili sankcijama iz njihove stranke Nezavisni blok, povukli svoje potpise sa apelacije.
Pet od 11 prvobitnih potpisnika apelacije – Novaković, Backović, Sokolović, Ahmetović i Bojić podržali su navedene izmjene Zakona kada su one usvojene u Predstavničkom domu.
Ove izmjene kojima se ukida “bijeli hljeb”, odnosno naknada koju dobijaju zvaničnici nakon prestanka mandata, sve do pronalaska novog zaposlenja, a najduže godinu dana, usvojene su u Predstavničkom domu u februaru 2015. godine, a u Domu naroda u martu 2016. godine, čime je ova privilegija na nivou BiH i zvanično ukinuta.
Ustavni sud BiH je na sjednici Velikog vijeća zaključio da postoji kršenje prava “Mrkonjićputeva” kao apelanta na pravično suđenje iz Ustava BiH i Evropske konvencije za zaštitu ljudskih prava i osnovnih sloboda pred nepristrasnim sudom.
