Advokat Ajanović: Neustavne odluke kriznih štabova u Federaciji BiH izazivaju pravnu i finansijsku nesigurnost fizičkih i pravnih lica
Nova Naredba Kriznog štaba Ministarstva zdravstva TK kojom se rad svih ugostiteljskih objekata na području Tuzlanskog kantona ograničava na najduže do 20.00 sati direktno je kršenje Odluke Ustavnog suda BiH AP-3683/20 od 22. 12. 2020. godine, kojom je utvrđeno kršenje ljudskih prava zbog donošenja neustavnih odluka organa u FBiH u vezi aktivnosti vezanih za sprečavanje širenja koronavirusa.
Naredbe kriznih štabova u Federaciji BiH koji nisu ovlašteni za donošenje odluka iz nadležnosti zakonodavnih organa direktno krše i član 17. Evropske konvencije za zaštitu ljudskih prava i osnovnih sloboda jer je definisano, citiram: “Ništa u ovoj Konvenciji ne može se tumačiti tako da podrazumijeva pravo bilo koje države, grupe ili lica da se upuste u neku djelatnost ili izvrše neki čin koji je usmjeren na poništavanje bilo kog od navedenih prava i sloboda ili na njihovo ograničavanje u većoj mjeri od one koja je predviđena Konvencijom”, završen citat.
Donošenje odluke o zabrani kretanja uvođenjem tzv. policijskog sata, kao i apsurdno ograničenje rada ugostiteljskih objekta do 20 sati ili ograničenje rada bilo koje djelatnosti, protivno je članu II ustava BiH i Evropskoj konvenciji koja je Ustavom BiH definisana kao prioritet nad svim zakonima, što uključuje i sve odluke bilo kojeg organa.
Pravno je apsurdno smatrati da koronavirus djeluje posebno radikalno u noćnim satima, kada je svakako smanjeno kretanje građana i u odnosu na ograničenje vremena rada ugostiteljskih objekata i na nepotrebno određeni policijski sat, te je nesporno da su odluke kriznih štabova u Federaciji BiH direktno kršenje prava na rad i prava na slobodu kretanja i izazivaju potpunu pravnu i finansijsku nesigurnost fizičkih i pravnih lica.
Kada bi se i smatralo da je zbog pogoršanja epidemiološke situacije osnovano donijeti mjere ograničenja rada bilo kojem poslovnom subjektu, takva odluka se može donijeti nakon donošenja adekvatnog zakona od strane nadležnog zakonodavnog organa, a prema uputi Ustavnog suda BiH, uz obavezu donošenja odluke o adekvatnom obeštećenju svih fizičkih i pravnih lica kojima se zakonskom odredbom oduzima ili ograničava pravo na rad, kao bi se spriječilo ugrožavanja egzistencije građana i poslovnih subjekata sa dugoročnim teškim posljedicama.
