Džaferović se obratio Ustavnom sudu: KS preuzima ovlasti BiH
Predsjedavajući Predsjedništva BiH Šefik Džaferović uputio je Ustavnom sudu BiH zahtjev za ocjenu ustavnosti Uredbe o kontroli javnih nabavki u svim institucijama čiji je osnivač KS.
Džaferović smatra da ovaj akt, koji je usvojila Vlada Kantona Sarajevo, nije u skladu sa Ustavom, te je zatražio od Ustavnog suda da ga stavi van snage.
– Uredba Vlade Kantona Sarajevo o kontroli javnih nabavki je neustavna jer ju je donio neovlašten organ, a njen sadržaj je suprotan odredbama Zakona o javnim nabavkama. Postupajući na ovaj način Vlada KS dovodi u pitanje princip vladavine prava u BiH, a posebno krši odredbe člana Zakona prema kojima su niži nivoi vlasti dužni pomagati državi BiH u ispunjavanju njenih međunarodnih obaveza što javne nabavke na osnovu Sporazuma o stabilizaciji i pridruživanju sa Evropskom unijom svakako jesu – navodi se u saopćenju iz Kabineta predsjedavajućeg Predsjedništva.
Sadržaj Uredbe u Kantonu Sarajevo krši i odredbe III/3.b Ustava Bosne i Hercegovine, s obzirom da se ne poštuje procedura predviđena Zakonom o javnim nabavkama koji je usvojila Parlamentarna Skupština Bosne i Hercegovine.
Također Uredba krši i odredbe člana IV/4. Ustava Bosne i Hercegovine, s obzirom da je svojim postupanjem Vlada Kantona Sarajevo ušla u okvir nadležnosti Parlamentarne skupštine Bosne i Hercegovine.
Na kraju saopćenja se navodi da je nedopustivo da niži nivoi vlasti nastoje preuzimati ovlasti države, bilo da se radi o entitetu Republika Srpska, Kantonu Sarajevo ili bilo kojoj drugoj nižoj administrativnoj jedinici.
