Građani BiH godišnje za uvjerenja o (ne)kažnjavanju uplate milione KM?!
Traže se dva uvjerenja, jedno koje košta 10, a drugo 15 KM, ali niko ne zna koliko se tačno novca slije u budžete od ovih davanja.

Prvo je Hrvatska kroz sistem e-građanin, a odnedavno i Srbija kroz e-upravu, uvela olakšice za svoje građane, kojima su potrebna uvjerenja o (ne)kažnjavanju i/li uvjerenje o nevođenju krivičnog postupka, koje se u našoj državi traži za različite vrste namjena, kao što je, naprimjer, prijava na konkurs za radno mjesto u organima uprave ili, recimo, za dobivanje oružnog lista.

Podatak koliko se novca slije u budžetske kase na različitim nivoima vlasti u BiH, niko sa sigurnošću ne može obznaniti, jer Agencija za statistiku BiH, kako nam je rečeno, nema mandat da prikuplja takve vrste statističkih podataka.

Građanima BiH traže se dva uvjerenja. Uvjerenje o nekažnjavanju vadi se u mjestu prebivališta kod nadležne policijske uprave. U oba entiteta za ovo uvjerenje plaća se taksa od 10 KM. Uvjerenje, kako nam je rečeno u većini kontaktiranih policijskih uprava, izdaje se najkasnije tri dana od dana podnošenja zahtjeva.

Uvjerenje o nevođenju krivičnih postupaka izdaje se u općinskim sudovima i jedina olakšica koja je nedavno uvedena, ogleda se u činjenici da se može izdati i na područjima gdje nemate stalno prebivalište.

Taksa za takva uvjerenja je 15 KM i u većini sudova se dobivaju istog dana. No, u nekim slučajevima vrše se provjere da li se krivični postupak vodi pred drugostepenim organom, odnosno kantonalnim sudom, tako da se uvjerenje može dobiti najkasnije u roku od tri dana.

Plaćanje obrasca

U bh. entitetu RS u osnovnim sudovima građani ne plaćaju takse kad se aplicira za posao. Jedini izdatak je 80 feninga, koliko košta obrazac koji moraju popuniti.

U Republici Srpskoj se za uvjerenje o nevođenju krivičnih postupaka za odgovornu osobu u pravnom licu ili za oružni list mora platiti 16,5 KM republičke takse.

Čak 1.000 ljudi se javi na konkurs

Advokat Azur Prnjavorac ističe da, prema stavu Agencije za zaštitu ličnih podataka BiH, kandidat za zapošljavanje poslodavcu, bez obzira na to je li u pitanju državni organ ili privatna kompanija, nije dužan dostaviti podatke iz kaznene evidencije.

– Organ ili institucija morali bi po službenoj dužnosti tražiti takve podatke. Ovako imamo situaciju da se po 1.000 ljudi javi na konkurse, uzme se po toj osnovi 10.000 KM, a primi se samo jedan kandidat. Moglo bi se u konkursima navesti da je kandidat koji dobije posao, dužan da u roku od 30 dana dostavi spomenuta uvjerenja. Na taj način bi građani uštedjeli nivac – smatra advokat Prnjavorac.
