Gradska uprava Tuzle omogućila prometovanje nacionalizirane vakufske imovine što je suprotno Zakonu

Nakon što je Gradska uprava Tuzle u javnosti pokušala odbraniti uzurpaciju vakufske imovine, prometovanje vakufom Turali-bega, oglasila se Vakufska direkcija Islamske zajednice u Bosni i Hercegovini. Saopćenje Vakufske direkcije prenosimo u cijelosti:

„Gradskoj upravi Tuzla je sada već dobro poznato da su raspolagali imovinom kojom nisu smjeli raspolagati te na taj način ne samo da su oštetili vakuf već su oštetili i Grad Tuzlu u cjelini.

Nesporno je da je nekretnina bila vakuf i upisana na ime Gazi Turali-begovog vakufa sve do 1946. godine. Tada se dešava nacionalizacija i vrši se oduzimanje predmetne vakufske nekretnine, bez ikakve naknade, te se predmetna nekretnina upisuje na ime opštenarodna imovina. Predmetnom nekretninom su upravljala javna preduzeća. Dakle, raniji društveno-politički sistem je oduzeo vakufsku imovinu, ali je nije prometovao i ista je služila za potrebe javnih preduzeća.

Zakon o stvarnim pravima Federacije BiH je zabranio prometovanje nacionalizirane imovine. Navedeno je određeno kroz imperativnu zabranu. Suština problematike kod ovog predmeta je upravo ta da je Gradska uprava omogućila prometovanje nacionaliziranom vakufskom imovinom, što je suprotno Zakonu o stvarnim pravima Federacije BiH.

Želimo još jednom ukazati javnosti na važnu činjenicu. Mi ne tražimo da se Islamskoj zajednici u ovom momentu vrati predmetna nekretnina jer ne postoji zakonski osnov da se vrati. Mi tražimo da se ponište protuzakonite radnje koje su uradili Grad Tuzla, Tuzla Remont i Bingo d.o.o., odnosno tražimo da se poništi prometovanje i da se vakufska nekretnina upiše na način kako je bila upisana kako bismo zaštitili naša buduća restitucijska prava.

Tačno je da je Vakufska direkcija 2015. godine pokrenula tužbu radi poništenja nagodbe, odnosno poništenja prometovanja nacionalizirane vakufske imovine. Tačno je da je tužba odbijena i da je trenutno ovaj postupak u fazi apelacije na Ustavnom sudu BiH. Međutim, želimo podsjetiti Grad Tuzlu na činjenice koje su utvrđene u toku sudskog postupka. Tužba je odbijena iz razloga što je sud utvrdio da Vakufska direkcija nema pravnog interesa odnosno ne može vratiti nekretninu jer je nacionalizirana. Ali ono što je najvažnije u obrazloženju presude sud je utvrdio da „ … za drugi dio nekretnina utvrđeno je da je pravo vlasništva Bingo d.o.o. koji je u parnicu uz saglasnost stranaka stupio na glavnu raspravu iako prema mišljenju ovog suda nisu bili ispunjeni uslovi za stupanje Binga d.o.o. u parnicu iz člana 362. stav 1. i stav 2. Zakona o parničnom postupku.“

Vidljivo je da su Grad Tuzla i Tuzla Remont suprotno zakonu o parničnom postupku uveli Bingo d.o.o. u postupak i to tek na glavnoj raspravi.

Dalje, sud je utvrdio, citiramo: „…stranke u parničnom postupku nisu ovlaštene utvrđivati da li je neka imovina privatizovana ili ne, a iz provedenih dokaza, odnosno akata Agencije za privatizaciju i ne proizilazi jasno koje su nekretnine privatizovane, pa su tuženi (Grad Tuzla, Remont Tuzla i Bingo d.o.o.) u prvom stavu sudske nagodbe raspolagali zahtjevom kojim ne mogu raspolagati.“

Dakle, sud je utvrdio da su u postupku o kojem govori Grad Tuzla raspolagali imovinom kojom nisu smjeli raspolagati. Ovaj dio sudske presude je bio dovoljan i pravobraniocu da pokrene postupak poništavanja prometovanja predmetne nekretnine. Ovaj dio presude je dovoljan da se pokrenu zakonom predviđeni postupci koji će utvrditi i krivičnu odgovornost pojedinaca koji su učestvovali u ovoj radnji.

Vezano za navode Gradske uprave da Vakufska direkcija nije učestvovala u postupku koji je vođen između Grada Tuzle i Tuzla Remonta od 2004. godine, želimo javnosti ukazati da Medžlis IZ Tuzla nije ni znao za navedeni postupak niti je traženo da se Medžlis IZ Tuzla uključi u postupak.

Želimo ukazati na jednu veoma važnu činjenicu. Postupak o kojem govori Gradska uprava Grada Tuzle je vođen između Grada Tuzle i Tuzla Remonta. Sve do glavne rasprave postojale su samo ove dvije strane u postupku. Na glavnoj raspravi kao stranka u postupku uvodi se Bingo d.o.o., što je u sudskoj praksi pravni nonsens i suprotan je Zakonu o parničnom postupku. Dakle na glavnu raspravu Grad Tuzla dovodi Bingo d.o.o. i zaključuju sudsku nagodbu u smislu prometovanja vakufskom imovinom. Ova nagodba je suprotna Zakonu o parničnom postupku jer Bingo d.o.o. nije bio stranka u postupku.

Nagodba je suprotna Zakonu o stvarnim pravima jer je Grad Tuzla raspolagao, odnosno prometovao imovinom kojom nije smio prometovati, što je vidljivo iz citiranog obrazloženja presude. Želimo Gradu Tuzla postaviti pitanje, ko je doveo Bingo d.o.o. i uveo ga u ovaj postupak kao stranku, suprotno zakonu i pod kojim uvjetima? Kako je Bingo d.o.o. znao za ovaj postupak i ko mu je omogućio da uđe u postupak i pod kojim uvjetima?

Vezano za navode za izmjenu Regulacionog plana na koji se poziva Gradska uprava, želimo ih podsjetiti da izmjena Regulacionog plana nema apsolutno nikakve veze s imovinsko-pravnim odnosima. Regulacionim planom se određuje vrsta i obim gradnje.

Postavljamo sljedeće pitanje Gradskoj upravi: Zašto nakon izdavanja urbanističke dozvole istu nije dostavila Medžlisu IZ Tuzla, kako bi Medžlis IZ Tuzla mogao pokrenuti zakonom predviđeni postupak? Zašto Gradska uprva Tuzla nije Medžlisu IZ Tuzla dostavila građevinsku dozvolu, kako bi Medžlis IZ Tuzla mogao pokrenuti zakonom predviđen postupak?I na kraju, zašto Gradska uprava Grada Tuzle još uvijek nije, nakon što je Medžlis IZ Tuzla u nekoliko navrata tražio da mu se dostavi građevinska dozvola, istu dostavila? Odgovor Grada Tuzle jeste da mi trebamo dokazati pravni interes. Pravni interes ima svaki građanin i isti nije potrebno dokazivati. Grad Tuzla od nas traži da dokažemo pravni interes da bi nam dostavio građevinsku dozvolu za nekretninu koja je bila u našem vlasništvu, što je apsurd.

Očigledno je da današnje rukovodstvo Grada Tuzle nije ni u čemu različito u odnosu na ranije društveno-političke sisteme koji su za cilj imali uništavanje vakufa i ekonomsko slabljenje Islamske zajednice. Islamska zajednica nikad nije koristila medije kao pritisak niti želimo da vršimo pritisak na nekog. Islamska zajednica je samo željela ukazati na štetne radnje koje Grad Tuzla radi.

Podsjećamo rukovodstvo Grada Tuzle da smo s njima održali nekoliko sastanaka o ovoj temi, podsjećamo ih da smo uputili niz protesta i zahtjeva za rješavanje ovog pitanja. Na te proteste nismo dobili odgovore.

Mi ćemo nastaviti s postupcima koje smo pokrenuli, a već smo pokrenuli novi parnični postupak o kojem Grad Tuzla „nema informaciju“ iako im je opunomoćenik Medžlisa IZ Tuzla dostavio tužbu. Tražit ćemo od nadležnih organa da utvrde da li postoji krivična odgovornost određenih osoba u ovim nezakonitim radnjama koje su dovele do trajnog gubitka vakufske imovine“, saopćeno je iz Vakufske direkcije Islamske zajednice u Bosni i Hercegovini.
