Policajci i borci došli na svoje, promijenjen Zakon o PIO

Predstavnički dom Federalnog parlamenta prihvatio je večeras na sjednici po hitnom postupku Prijedlog zakona o izmjenama i dopunama Zakona o penzijskom i invalidskom osiguranju u FBiH.

Kao razlog za izmjene i dopune, Vlada je navela i Odluku Ustavnog suda BiH, te su poduzete mjere i aktivnosti s ciljem harmonizacije odredaba ovog s drugim odgovarajućim zakonskim propisima.

Prema današnjem obraćanju zastupnicima federalnog ministra rada i socijalne politike Veska Drljače, jednom od izmjena i dopuna dodatno je precizirana norma kako bi policijski službenici na državnom nivou, u smislu penzionisanja i načina izračuna penzija, bili izjednačili s policijskim službenicima na nivou FBiH. Time je omogućen jednak tretman svih policijskih službenika u BiH budući da oni s prebivalištem u FBiH pod jednakim uslovima uplaćuju doprinose za PIO.

Nadalje, izmjenom člana 44. stav (5) su pripadnici Oružanih snaga BiH dovedeni u ravnopravan položaj sa ostalim osiguranicima, tako da im lični bodovi za svaku godinu posebnog staža, umjesto 0,5, po novom iznose 1,00 za priznatu punu godinu ostvarenog posebnog staža, obrazložio je također ministar.

Prema novom zakonskom rješenju, povredom na radu smatra se i ona zadobijena u pripremama za odbranu, odnosno u odbrani BiH u periodu od 18.9.1991. do 23.12.1995. godine.

Napominje se i da je Vlada FBiH na sjednici održanoj 12.12.2019. godine zadužila Federalni zavod PIO da provede mišljenje Federalnog ministarstva rada i socijalne politike od 11.12.2019. godine. U tom mišljenju stoji da je u postupcima priznavanja prava na porodičnu penziju udovicama šehida odnosno poginulog branioca i udovca šehida žene odnosno poginule braniteljice, potrebno primijeniti odredbu člana 17. Zakona o PIO. Ova odredba, između ostalog, propisuje da je osoba obavezno osigurana za slučaj invalidnosti i smrti zbog povrede na radu i profesionalne bolesti, za vrijeme vršenja određenih javnih funkcija ili građanskih dužnosti po pozivu nadležnih organa i organa jedinice lokalne samouprave.

Uz ostalo, dopunjena je odredba po kojoj se sada članom porodice umrlog osiguranika smatra i vanbračni partner. Vanbračnim partnerom smatra se osoba koja je takvom definisana Porodičnim zakonom Federacije BiH, a svoj status utvrdila je u sudskom postupku.

Novina u Zakonu je i mogućnost vanrednog usklađivanja penzija (izuzev najviše) sve dok najniži iznos penzije ne dostigne jednu petinu iznosa najviše penzije ostvarene po zakonu, ali pod uslovom da je stopa rasta realnog bruto domaćeg proizvoda u prethodnoj godini veća od tri posto i ako budžet Federacije BiH nema akumulirani deficit, a najviše do stope rasta BDP-a u prethodnoj godini.
