Ustavni sud BiH: Šume nisu vlasništvo Republike Srpske već države BiH

Ustavni sud Bosne i Hercegovine utvrdio je da nisu u skladu sa Ustavom BiH pojedine odredbe Zakona o šumama Republike Srpske, i to u dijelu u kojem se navodi da su šume vlasništvo RS-a.

– S obzirom na to da je na osnovu ranije prakse iz nekoliko odluka, od kojih je vodeća o statusu državne imovine BiH, Sud je zaključio da Republika Srpska kao entitet u okviru BiH nema ustavnu nadležnost za rješavanje pitanja državne imovine dok se to ne riješi odgovarajućim zakonom na nivou BiH – izjavio je za Srnu registrar Ustavnog suda BiH Zvonko Mijan.

Apelaciju povodom Zakona o šumama RS-a je podnijelo sedam delegata Vijeća naroda RS-a Mihnet Okić, Alija Tabaković, Džemaludin Šabanović, Faruk Đozić, Muris Čirkić, Ahmet Čirkić i Samir Baćevac.

Oni smatraju da su članovi tog zakona neustavni i štetni po BiH.

Zakon o šumama RS-a mijenjan je nekoliko puta. Izmjena koja se odnosi na vrhovnog titulara šuma u ovom entitetu mnogima je bila sporna.

Odluka Ustavnog suda BiH znači da je definitivni titular imovine šuma u RS-u država Bosna i Hercegovina.
